Professor Emily Bremer wins Emerging Scholar Award from AALS

Notre Dame Law Professor Emily Bremer is the winner of the American Association of Law Schools Section on Administrative Law’s Emerging Scholar Award for 2023.

Bremer won the recognition for her article “The Rediscovered Stages of Agency Adjudication,” which was published last year in the Washington University Law Review.

In the article, Bremer revisits the New Deal-era research underlying the Administrative Procedure Act of 1946 to rediscover a lost understanding of the distinction between informal and formal adjudication. These are not merely two modes of adjudication but are rather consecutive stages in the administrative process. The research clarifies the meaning of the APA and calls upon courts and scholars to rethink the modern approach to interpreting and applying the APA’s formal hearing requirements.

“This is a well-deserved honor for Professor Emily Bremer,” said G. Marcus Cole, the Joseph A. Matson Dean and Professor of Law at Notre Dame Law School. “She has distinguished herself as a creative and insightful scholar, and I’m confident that her contributions to the field of administrative law will only continue to grow in the years ahead.”

Bremer has been a member of Notre Dame Law School’s faculty since 2018. She teaches and writes in the areas of administrative law, regulatory process, and civil procedure. Her scholarship focuses primarily on matters of procedural design, with a recent focus on the legal requirements and policy considerations that apply in administrative adjudication. She serves as a Public Member of the Administrative Conference of the United States, a small, free standing federal agency charged with improving government processes, procedures, and performance. She is a regular contributor to the Yale Journal on Regulation’s Notice & Comment blog.

The Emerging Scholar Award will be presented at the AALS 2023 Annual Meeting on January 5 in San Diego.
