Each year the U.S. Customs and Borders Protection seizes thousands of products that infringe U.S. intellectual property rights. The U.S. International Trade Commission (ITC) investigates claims that imported goods violate intellectual property rights and, under Section 337 of the Tariff Act, can issue exclusion orders which prevent counterfeit goods from entering the U.S. But what are the facets of the ITC as a forum for disputes, and how can a lawyer best advocate for their client to prevent the importation of counterfeits of their goods? Tim Sendek, NDLS '07 and a partner at Akerman, joins us to share his insights.
