Clynes Chair in Judicial Ethics Lecture: Eduardo Ferrer Mac-Gregor

“What do we talk about when we talk about judicial dialogue? Reflections from a Judge of the Inter-American Court of Human Rights.”

Judicial dialogue is a topic that has gained academic attention during the past few years. As domestic and international courts and tribunals tend to consider, and even incorporate, the criteria of other courts to interpret human rights treaties, the notion of judicial dialogue constitutes one of the most innovative features of judicial relations in the 21st century.

Little has been said by the primary users of this ‘technique’— the judges themselves. Judge Ferrer Mac-Gregor will discuss the notion of judicial dialogue from his experience as Judge of the Inter-American Court of Human Rights, with a special reference to the dialogue that has occurred among the Court in San José, its European colleagues in the European Court of Human Rights, and the domestic courts in Latin America. He will reflect on the past, present and future of judicial dialogue, as an evolving process accompanying the development of the Inter-American Court of Human Rights itself.
