Prof. Nagle predicts impact of an environment-friendly federal judiciary

Greenwire, an energy and environmental policy news service, interviewed Notre Dame Professor of Environmental Law John Nagle about how an influx of Democratic judicial appointees might impact environmental law. President Obama could significantly reshape the federal judiciary that decides a majority of environmental law cases.

“Groups that are opposed to stricter environmental regulations will naturally turn to the conservative-leaning federal courts if the other two avenues (Congress and the White House) have been blocked,” Nagle told Greenwire. “But what’s going to happen to these challenges to the more robust environmental regulations once many of these judicial appointments go through?”
