Given the extraordinary amount of power and discretion that police officers wield—and the incredibly high stakes if they abuse that power—one might expect police to be held to a significantly higher standard than ordinary citizens. Instead, the opposite is true: Indeed, it is fair to say we have adopted a policy of near-zero accountability for police and other government officials, the cornerstone of which is the judge-made doctrine of qualified immunity—a doctrine that has no sound basis in law or policy, and should be eliminated with all deliberate speed.
