In a few weeks, the Supreme Court will hear Oil States Energy, one of the most important Article III cases in a decade. In that case, the Court will confront the question of whether administrative agencies may adjudicate disputes between private litigants—or whether such cases must be decided in Article III courts. Professor Greg Reilly, Chicago-Kent, will be previewing the arguments on both sides and discussing what limits (if any) Article III imposes on agency adjudication.
